The reporter learned today that the Daxing Court has ruled that long-term excessive noise has affected Ms. Wang's physical and mental health. The developer, the real estate company, should compensate Ms. Wang with 10000 yuan in emotional comfort and carry out noise reduction renovations in the equipment room.
Ms. Wang claimed that she moved into the community she purchased in October 2005. After checking in, Ms. Wang noticed continuous noise and vibration indoors. After investigation, it was found that the next floor of the house where she lives is the equipment room of the building, including the domestic water pump supply room, sewage pump station, etc.
In the winter of 2005, Ms. Wang discovered that the indoor noise reached a maximum of 100 decibels after the water pump was started and pressurized, and the sound of turning up the TV couldn't be covered.
Due to long-term exposure to noise, Ms. Wang claimed to suffer from symptoms such as tinnitus and neurasthenia, and even developed a fear of going home.
Ms. Wang stated that the developer did not explicitly state that the basement of the residential property being sold was an equipment room, which seriously violated her legal rights. Therefore, she sued the developer in court and demanded compensation of 200000 yuan for mental damages and measures to eliminate noise pollution.
The developer stated that the house was designed according to regulations and the noise level was not as loud as Ms. Wang claimed, so there was no need to inform when selling the house.
Court trial
After trial, the Daxing Court found that Ms. Wang's residence belongs to the category of areas specified in the "Urban Area Environmental Noise Standards". The measured noise level inside the residence was 36 decibels, exceeding the maximum nighttime limit standard.
In response to this, the developer should take measures to improve the environmental quality by addressing the excessive noise generated by the heat exchange station, drainage maintenance room, and electrical maintenance in the equipment room on the basement level.
The long-term excessive noise in the residential living environment has disrupted and affected Ms. Wang's normal life and physical and mental health. The developer should make corresponding compensation.
So, the court made the above judgment.
